DREDGING AND SAND BYPASSING WORKS ADJACENT TO THE PORT OF ASHDOD AND ADJACENT TO THE PORT OF HAIFA

Pursuant to the Agreement on Government Procurement and the Tender Laws of the State of Israel, the IPC notifies DREDGING CONTRACTORS that the IPC wishes to Tender for the Supply of Works to carry out DREDGING AND SAND BYPASSING WORKS ADJACENT TO THE PORT OF ASHDOD AND ADJACENT TO THE PORT OF HAIFA

1. The Works consist of:

ADredging in the Ashdod Port area and North of the Ashdod Marina and Transporting and Placing the Sand approximately 5-10 Kilometers North of the Port of Ashdod .

 The transfer of up to 180,000 m3 of sand during the months September, October and/or November for each  of the years 2012 ,2013 and 2014, and afterwards, in accordance with the sole discretion of the IPC, optionally for the years  2015 and/or 2016. The IPC has the right to change the work season(s) at its sole discretion.

Dredging in locations from the South of Ashdod Port to the Marina area will be performed in approximate water depths of -4.2m to -8.5m ILSD.  Dredging in Ashdod Port will be performed in water depths of approximately -27 m ILSD. The placing will be performed in approximate water depths of -3m to -5m ILSD.

The quantity to be dredged, transported and placed shall be determined in the annual task order that shall be issued to the Dredging Contractor. The IPC shall notify the Contractor in writing (that is, issue a written yearly "Notice to Proceed") of any required annual dredging operations for the performance of the said operations ,as it is further specified in the Tender Documents.
The IPC shall secure, for each year, the required "dumping permit" for the performance of these works.

BDredging and Sand By-Passing Works Adjacent to the Port Of Haifa

The one-time transfer of up to 50,000 m3 of sand from the Borrow Area, which is the national sand storage area westward of and outside the Main Breakwater of the Port of Haifa, at water depths of approximately -12m to -14m ILSD to the Placement Area, which is located in the shallow waters (-3m to -4m ILSD) about 5-7km North of the Port of Haifa along the coast near Kiryat Haim.  It is anticipated that the Works shall be awarded only once in the five-year period beginning 2012; thus, the Works shall be performed only once in accordance with the instructions of the MOEP to the IPC, and no later than the end of 2016.

The quantity to be dredged, transported and placed shall be determined in a task order that shall be issued to the Dredging Contractor. There is no minimum quantity with regard to these Works. The IPC shall notify the Contractor in writing the commencement of the dredging operations, as it is further specified in the Tender Documents.  The IPC shall secure the required "dumping permit" for the performance of these Works.

2.  The IPC shall proceed with the selection of the Contractor through a two stage process with Prequalification in the first stage. Contractors wishing to participate in the tender will first be selected on the basis of the pre-qualification criteria set in the Tender Documents. The sealed bids of only those Contractors which have been prequalified will then be opened and the Bids considered in accordance with the criteria set out in the Tender Documents.

3. THRESHOLD CONDITIONS FOR PRE QUALIFICATION:

3.1 With regard to the Dredging and Sand By-passing Works in Ashdod and Haifa, the applicant must show evidence that it owns (or has made a conditional agreement subject to the award of the Works, for the three years, 2012, 2013, 2014 for the performance of the Works by a subcontractor that owns or can supply the applicant with a Trailing Suction Hopper Dredger ("TSHD") 800 cu.m. minimum hopper capacity, equipped with the discharge  facilities and the other characteristics which are further set out in the Summary and in the binding Tender Documents. The conditional agreement must include an option, to be held by the applicant awarded the works, of extending that conditional agreement for a period of 2 additional years.

3.1.1 The applicant may propose several dredgers that comply with  the requirements. Further with regard to equipment, and not as a "Threshhold Requirement", all applicants should note that all of the  equipment to be supplied by the Bidder awarded the Works and actually to be used in the works must comply with the Requirements of Israel's Ministry of Environmental Protection ("MOEP"), and with the Requirements of the Shipping Department of  Israel Transport Ministry, which are in force at the time of the equipment's use and, additionally, in accordance with all other relevant requirements. 
 The applicant must furnish appropriate documentation concerning the meeting of these requirements by the equipment no later than 10 days after the receipt of the yearly Notice to Proceed and before the arrival of the equipment on the Site. The equipment, upon its arrival at the site, shall be examined to ensure compliance with the requirements. All of the Works must, thereafter, be actually performed in accordance with the requirements of the MOEP and with all other relevant requirements. 

3.2 The applicant must demonstrate previous cumulative dredging experience of 500,000 cu.m of dredging works in the period from 2006 through 2011.

3.3 The applicant must provide a Bid Security (Bid Bond) in the amount of 1,000,000 New Israeli Shekels or 200,000 Euros or 270,000 U.S. Dollars. (to be attached to the Prequalification Documents) valid until 5.11.2012 in the form of an unconditional on-demand Bank Guarantee, issued by one of the following 5 Israeli Banks: Bank Leumi, Bank Hapoalim, Bank Discount, Bank Mizrahi-Tfahot, The First Internal Bank, or a foreign Bank which is rated with the international rating for Foreign Currency of rate A by S&P or an equivalent rating by one of the other rating agencies (Moody's, FITCH). In the event that the Bank of the required rating is located in a nation which does not maintain full diplomatic relations with the State of Israel at the time of the issuance of the Guarantee, the bid security shall be accompanied by a counter-guarantee from an Approved Bank located in Israel or located in a nation which maintains full diplomatic relations with the State of Israel .The Bank Guarantee will explicitly specify that it is for "Tender No. 23/5005/06/10  - Dredging and Sand Bypassing Works Adjacent to the Port of Ashdod and Adjacent to the Port of Haifa" all as further set out in the binding Tender Documents.  The IPC shall be entitled to demand an extension of the period of this Bank Guarantee for a period of an additional six months.   The Applicant awarded the Works is required to  supply, within the specified time and in accordance with that set out in the Tender Documents, a Performance Bond in the amount of 1,100,000 NIS with regard to its performance of the Works.

3.4   The presentation of a letter of reference, issued by the Bank where the Tenderer has been managing its account, for at least the last three years preceding the date of submitting the Tender, attesting to the financial stability of the Tenderer. The letter shall relate to the financial stability of the Tenderer as of one month before the last date for the submission of the Tender and shall be in accordance with the text set out in the Prequalification Documents.

4.  The Tender Documents, that is the Prequalification and Bid Documents, may be examined, without charge, beginning on 27.2.2012 at the offices of the IPC, in Room 1103 on the 11th floor, 74 Menachem Begin Road, Tel Aviv, Israel, Sundays through Thursdays, between 9:00 and 14:00.

5. They may be purchased, at that office, between the hours of 9:00 to14:00, Sundays through Thursdays, after payment of the non-refundable amount of 1,500 NIS (which sum includes Value Added Tax).

6. An applicant that chooses to submit  a Bid after its purchase of the Tender Documents must thereafter pay an additional nonrefundable participation fee in the sum of 12,000 NIS including VAT.

7. The above-mentioned fees (of 1,500 NIS and 12,000 NIS, including VAT) can be paid in the Treasurer's Department at the offices of the IPC ,or can be deposited in the Bank Account of the IPC at Bank Hapoalim, Branch 508, Account Number 7518.

8. There will be a pre-bid meeting with potential bidders on 12.3.2012. 
The meeting will take place at the office of  Baran Projects Constructions  Ltd./A.R.- A.D.Y.R. Construction Ltd. at the 
Coal Terminal at the way to the  Electrical Plant of the Port of Ashdod at 10:00 on that day.

 Contractor’s representatives wishing to participate in the pre-bid meeting shall notify the IPC of the name(s), I.D. or passport   
  number, and the vehicle  number by 5.3.2012  (so that entry passes to Ashdod Port can be provided) to:  David Engel,

9.  Those who wish to Bid must submit their Prequalification Documents and the Bid Documents to the IPC in a sealed envelope  no later than 12:00 Local Israeli Time on 7.5.2012 to the Tender Box located in the offices of the IPC, 74 Menachem Begin Road, Tel Aviv, 10th floor, Room 1010.

11. The Tender process shall be governed solely by the conditions set out in the Tender Documents and not by the contents of this Advertisement or any Summary Announcement.

12. The process may involve negotiation. Thus, the IPC  in its discretion, may negotiate with Applicant(s) whose bids have been found to be appropriate.

13.     A Selected Non-Israeli Tenderer must sign and enter into an undertaking with the State of Israel with regard to BUSINESS COOPERATION as a condition precedent to the signing of a Contract with the IPC and the entry into force of that Contract, all in accordance with the Regulations concerning Tenders and Preferences for Local Products and Business Cooperation to the extent that the Regulations do not contradict the obligations of the State of Israel under any international treaty. The BUSINESS COOPERATION shall be at a level of 20% of the Contract Price with regard to entities from Nations which are parties to the Agreement on Government Procurement, or 35% with regard to entities from Nations which are not parties to the Agreement on Government Procurement.

14.    The IPC reserves the right to reject or accept any application in accordance with its evaluation of the materials presented and/or to cancel the prequalification and bid process and reject all applications.

Further, the IPC is not obligated to order the Works described in the Tender Documents from any particular party nor is the IPC obligated to order the least expensive Works offered nor is it obligated to order any such Works at all. The IPC may, at any time prior to the signing of a binding contract, decide not to order the Works described in the Tender Documents.
