1. In accordance with the Government Procurement Agreement and the Mandatory Tenders Law 5752-1992, Israel Ports – Development and Assets Company Ltd. ("IPC" or "the Company") hereby invites bidders to take part in a tender for providing quality assurance services for civil engineering projects under the responsibility of IPC, as further detailed in the tender documents ("the Invitation", and "the Services", respectively). The Services shall include, inter alia:

1.1. Quality assurance including inspection and control of the contractor's quality control system;

1.2. Evaluation and approval of the contractor's quality control plan;

1.3. Preparation and submission of a quality assurance plan for the project as shall be defined by IPC;

1.4. Appointment and management of the quality assurance team (laboratory, engineers, surveyors etc.) as shall be approved by IPC;

1.5. Initiation and execution of tests for works and materials;

1.6. Detection, tracking and repairment of discrepancies;

1.7. Inspection of the contractor's site records;

1.8. Submission of reports to the Engineer;

1.9.  Coordination with and representation of IPC with respect to different planning committees or other relevant authorities;

1.10. Attending weekly coordination meetings or other project meetings as shall be required by IPC

1.11. Employment of designers or advisors as shall be required for the purpose of providing quality assurance services for a project.

1.12. Preparation of professional opinions for the purpose of any legal proceedings and appearance before any judicial entity as shall be required by IPC

1.13. Any other quality assurance services as shall be required by IPC.

2. The tender shall include a number of stages and shall be conducted as an Electronic Tender pursuant to regulation 19c of the Mandatory Tenders Regulations 1993, all as further detailed in the tender documents.

3. The Company shall execute a framework contract with the company/ies selected as the preferred bidder/s. The contract period shall be (5) years. IPC shall have the option, at its sole discretion, to extend the contract for an additional period/s up to three (3) additional years (the maximum aggregated contract period shall be eight (8) years).

4. IPC shall be entitled to select one or more preferred bidders, as set forth in the Invitation.

5. Bidders shall comply with the following threshold conditions. The full details of the tender requirements and how compliance therewith is to be demonstrated are included in the Invitation.

6. Threshold Requirements

A. The Bidders Professional Experience

6.1. During the period between 1.12010 until Bid Submission Date, the Bidder provided quality assurance or quality control services for at least three (3) projects for the Construction of at least one (1) Public Road, provided that:

(1) The value of each of such projects was at least twenty five million NIS (25,000,000 NIS); and

(2) The value of at least one of such projects was at least fifty million NIS (50,000,000 NIS).

6.2. The Bidders holds a valid certification for  ISO:9001;

6.3. The Bidder meets all the applicable requirements under the Public Entities Transaction Law, 5736 – 1976, as follows:

6.3.1. Holds a valid approval from a tax officer or a certified public accountant testifying to proper bookkeeping practices, in accordance with the Income Tax Ordinance and the Value Added Tax Law, 5736 - 1975.

6.3.2. Holds a valid approval from a tax officer or a certified public accountant testifying to compliance with the reporting requirements to the tax officer of its income and to the VAT authority of transactions to which VAT applies in accordance with the Value Added Tax Law 5736 – 1975.

3.3.3. Complies with the requirements under Article 2B to the Public Entities Transactions Law in respect of minimum wages and the employment of foreign workers in accordance with the law.

6.3.4. Complies with the requirements under Article 2B1 to the Public Entities Transactions Law in respect of the Equal Opportunities for People with Disabilities Law 1998.
The Threshold Requirement of this Clause 6.3 applies to corporate entities which are "Residents of Israel" ("תושב ישראל") as such term is defined in the Income Tax Ordinance [New Version].
A participant which is a foreign corporate entity not registered in Israel is not required to comply with the Threshold Requirements of this Clause 6.3.

6.4. No Going Concern

The participant's audited financial statement for the year 2016 does not include a Going Concern notice or warning.
A Bidder which is not a corporate entity is not required to comply with the Threshold Requirements of this Clause 6.4.

B. Proposed Quality Assurance Manager's Professional Experience

The Bidder's proposed quality assurance manager ("the Proposed Quality Assurance Manager") shall meet all the following professional experience requirements:

6.5. The Proposed Quality Assurance Manager shall be the owner, shareholder, organic employee of the Bidder or a Contracting Entity therewith;

6.6. During the period between 1.1.2010 until Bid Submission Date the Proposed Quality Assurance Manager managed the quality assurance or quality control of at least three (3) projects for the Construction of at least one (1) Public Road, provided that:

(1) The value of each of such projects was at least twenty five million NIS (25,000,000 NIS); and

(2) The value of at least one of such projects was at least fifty million NIS (50,000,000 NIS).

6.7. The Proposed Quality Assurance Manager has experience of at least ten (10) years as an engineer, out of which five (5) years of experience in management or inspection of civil engineering projects which included the Construction of at least one Public Road.

6.8. The Proposed Quality Assurance Manager is registered in the Israeli registry of Engineer or Architects in the field of civil engineering.

7. Requests for Clarification

The Bidders may refer questions and request clarifications with respect to the Invitation, in writing from IPC until September 28th, 2017 at 12:00 (noon) local time, in accordance with the detailed instructions in the Invitation.

8. Receiving the Invitation Documents:

8.1. The Bidder shall download the form to be filled out from the IPC web site and shall send the form with the complete details to the email address: ENG1-IPC@israports.co.il, requesting the receipt of the Invitation Documents.

8.2. Following the above procedure, the Bidder will receive a response e-mail with a Username and Password from the https://ramdor.net web site.
 

8.3. The Bidder shall not make any changes in the Invitation Documents. Only the version approved by the Tender Committee and published in the https://ramdor.net web site shall be the final and binding version and shall govern the prequalification process.

9. The Bidder’s proposals shall be submitted by no later than October 31st, 2017 at 12:00 (noon) local time, in an electronic format to the IPC’s Electronic Tender Box, at https://ramdor.net, except for the Bid Bond which shall be submitted to a designated Tender Box at IPC offices, 74 Menachem Begin Road, Tel Aviv, 10th floor, room no. 1010. Only proposals which shall be found in the Electronic Tender Box until the submission deadline (expect for the Bid Bond which shall be submitted to the Tender Box in IPC offices) shall be considered by the Tender Committee.

10. This notice is not exhaustive and does not include the full details of the Invitation. In the event of conflict between this notice and the Tender Documents, the Tender Documents shall prevail. The Hebrew version shall prevail over the English version.
